Terms and Conditions

These Terms and Conditions (“Terms”) govern and regulate the relationship between JackpotStar 777 (Pty) Ltd (“Jackpotstar”) trading as Lotto247 (“Lotto247”), and its customers (“Customer(s)). These Terms include, amongst others, important provisions concerning the conditions under which a Customer may establish and operate a betting account (“Account” or “betting account”) with JackpotStar, as well as restrictions and conditions which will apply to the relationship between JackpotStar and a Customer (collectively, the “Parties”) and the various betting transactions and products which JackpotStar offers (“Services”). It is therefore essential that you read these Terms fully and ensure that you have understood and agree to be bound by them before establishing a betting account with JackpotStar.

JackpotStar is a private company incorporated and registered in terms of the laws of South Africa and is licensed to accept bets under a bookmaker licence issued to it by the Western Cape Gambling and Racing Board (the “Gambling Board”).

JackpotStar operates a website through which the Services are available at www.lotto247.co.za (“Website”).

JackpotStar is responsible for the operation of the Website, the Accounts, the placing and acceptance of bets, taking Customers’ stakes and forwarding of pay- outs to the Customers in accordance with these Terms. JackpotStar acts as a bookmaker, determines the odds, calculates the pay- outs and is responsible for the payment of pay- outs and pays out the pay- outs in South Africa. Through complex hedging measures and instruments (both financial instruments and the purchase of actual entries into the underlying lotteries), JackpotStar guarantees the pay- out of all winning bets.

JackpotStar has and reserves the right to update these Terms from time- to- time in order to address legal and regulatory changes, to incorporate changes in our business or the Services offered, or to improve the clarity and helpfulness of these Terms. When the Terms are updated, we will post them on our Website and it shall be the Customer’s responsibility to check the Website from time- to- time to review any updated Terms when they are posted. The updated Terms shall govern the relationship between JackpotStar and the Customer once they have been posted to our Website. The Customer is responsible to retain copies of transaction records and service policies and rules.

The Customer accepts that his use of the Services is for his own personal entertainment and non- professional use and that, in making use of the Services, he is acting on his own behalf. The Customer acknowledges that any activities undertaken by him in breach of these Terms are strictly prohibited.

By accepting these Terms, the Customer acknowledges that he is fully aware that there is a risk of losing money when gambling and betting and that he is fully responsible for any such loss. The Customer agrees that his use of the Services is at his sole option, discretion and risk. In relation to the Customer’s losses, the Customer shall have no claims whatsoever against JackpotStar or any of its partners, directors, officers or employees.

By opening an Account or using the Services, the Customer represents, warrants and agrees that he will comply with all applicable statutes, regulations and rules, as amended or replaced from time to time (“applicable laws”) when he uses the Services. JackpotStar is not liable for any illegal or unauthorized use of the Services by the Customer or any third party. By accepting these Terms, the Customer agrees to cooperate with JackpotStar in ensuring ongoing compliance with the applicable laws.

Each of the individual clauses within these Terms contains important provisions which the Customer must read in full and agree to before opening a betting account with JackpotStar.

1. ELIGIBILITY TO BET

1.1. No person may apply for an account or place a bet with JackpotStar or enforce any debt arising out of any such bet unless such person:

(i) is a natural person;
(ii) is at least 18 years of age;
(iii) has completed the Account application form accurately and in full and has been accepted as an Account holder by JackpotStar;
(iv) is not listed on the register of excluded persons contemplated in section 14 of the National Gambling Act, 2004, and
(v) is not in breach of these Terms.

1.2. When a Customer completes the Account application form he thereby warrants that he has read, understood and accepted these Terms and all rules relating to betting on sporting events or any other lawful contingency published on the Website from time to time; and the Customer will be deemed thereby to have made an application requesting JackpotStar to:

(i) conclude an agreement in accordance with these Terms for the provision of a betting service on sporting events and any other lawful contingency to the Customer;
(ii) for the purposes of paragraph (i), to open a betting account in the Customer’s name, which application shall be deemed to have been granted, and the which Account shall be deemed to have been opened, if JackpotStar informs the Customer thereof or accepts (a) bet(s) subsequent to receipt of the completed Account application form.

2. ACCOUNT OPENING PROCESS AND RELATED INFORMATION

2.1. The Customer warrants that all information provided in the Account application form completed by him is and shall remain true and correct. The Customer undertakes forthwith, and in writing, to advise JackpotStar of any and all matters or changes in details that might have a bearing on an approved application or the Customer’s identifying and/or contact details, creditworthiness, legal capacity or continued eligibility as a customer of JackpotStar.

2.2. JackpotStar:

(i) reserves the right to:

a. accept an application for a new Account;
b. decline an application for a new Account for any reason whatsoever
c. cease accepting bets from a Customer in its sole discretion for any reason whatsoever, which reason JackpotStar shall not be obliged to furnish or disclose to the Customer or any other person; and
(ii) shall decline an application for a new Account if:
a. the Account application form has not been completed in full; and/or
b. the information contained in the Account application form is established by JackpotStar to be incorrect or subject to a material omission; and/or
c. any information required to be submitted in conjunction with the application form or requested by JackpotStar prior or subsequent to the submission of the application form is not provided by the Customer in the manner or format or within such time period as JackpotStar may specify.

2.3. The Customer shall be solely responsible for the safekeeping and proper use of all his Account details and other information that will enable him to place a bet. The Customer hereby undertakes that he shall:

(i) not apply for or hold more than one Account with JackpotStar;
(ii) not apply for an Account in the name of or on behalf of any other person;
(iii) use only the Customer’s own Account for the purposes of engaging in betting;
(iv) use only the Customer’s own banking account for the purposes of engaging in betting; and
(v) not permit or enable any other person to place a bet, directly or indirectly, by making use of such Account reference number, username or personal identification number as is or may be furnished to the Customer by JackpotStar from time to time,

and JackpotStar shall accordingly not be liable to honour any transaction pertaining to any Account so held or applied for or to pay out any winnings in respect of any bet so placed. The Customer indemnifies for and holds harmless JackpotStar against any claims, losses or damages arising from such bets.

2.4. The Customer undertakes to notify JackpotStar immediately if the Customer’s Account information is lost, stolen, misappropriated, or utilised by someone other than the Customer or the Customer has reason to believe that any of the aforegoing has occurred. The Customer shall be liable for all bets placed with JackpotStar and any payments made by or to JackpotStar in respect of any purchase and/or transaction concluded on the Customer’s Account prior to notification in accordance with this clause.

2.5. Once an Account has been created in the name of the Customer, the Customer will be required to log into this Account using the Customer’s personalised login details (including the Customer’s username and password) for the purposes of undertaking betting transactions with JackpotStar.

2.6. If there is any difference between the information entered by a Customer at the time of logging into the Customer’s Account and the information supplied to JackpotStar by the Customer at the time of establishing the Account, the Customer will not gain access to the Customer’s Account and will be required to contact JackpotStar for assistance.

3. FICA COMPLIANCE

3.1. JackpotStar has certain obligations imposed on it by the provisions of the Financial Intelligence Centre Act, Act 38 of 2001, as amended (“FICA”), which details the requirements in relation to identity establishment and verification procedures, customer due diligence, the recording and ongoing monitoring of transactions, the retention of records and related matters. All of these requirements have been put in place in order to ensure that the betting services provided by licensed bookmakers such as JackpotStar are not unlawfully used as vehicles for money laundering and/or the financing of terrorism or other criminal activities.

3.2. Where FICA or its associated regulations and instruments specify such procedures and/or restrictions, JackpotStar will operate in accordance with such procedures and/or restrictions. Where FICA does not specify such procedures and/or restrictions, JackpotStar shall implement its own procedures and/or restrictions (subject always to any applicable legislation). For further information on FICA please log on to www.fic.gov.za.

3.3. In the online environment, JackpotStar is required by FICA first to establish and verify the identity of all Customers before it may lawfully create a betting account for any such Customer. As part of the Account registration process, prospective Account holders will be required to disclose the following personal and related particulars:
(i) full names;
(ii) South African Identity Number or Passport Number;
(iii) residential Address;
(iv) E-mail Address;
(v) mobile and/or landline telephone number(s); and
(vi) the source of the funds to be used for the purposes of the betting account.

3.4. No betting account will be created unless the identity of the Customer who applied for same has been conclusively established and verified by JackpotStar.

3.5. The following procedures will be followed by JackpotStar in relation to a Customer in respect of whom proof of identification and residential address is required:
(i) Where a Customer presents his identification document (ID or passport) in person, JackpotStar shall make a photocopy of such document on the licensed premises and verify that same is a true copy of the original, which shall be filed and retained for record purposes.
(ii) Where an identification document is transmitted to JackpotStar via facsimile transmission or by normal or electronic mail, such documents will be required to be current (unexpired in the case of passports) and certified as true copies of the original.
(iii) A driver’s licence may be accepted as proof of identification, provided that:
(a) the Customer is unable to produce an Identity Document for reasons which are acceptable to JackpotStar in the circumstances;
(b) the driver’s licence is valid/current (has not expired), and
(c) the driver’s licence reflects, on the face thereof:
● a photograph of the bearer;
● the full names or initials and surname of the bearer;
● the date of birth of the bearer; and
● the Identity Number of the bearer.
(iv) Utility bills and similar documents submitted as proof of residential address shall be dated no earlier than three (3) months prior to the date of submission to JackpotStar thereof.

3.6. By completing JackpotStar’s online betting account application form, the Customer confirms and irrevocably consents to and that JackpotStar shall be entitled to conduct such identification, credit and other verification and/or screening or security checks (including, but not limited to, verifying the Customer’s source of funds) that JackpotStar may choose to perform and/or is required to perform by applicable legislation, any regulatory authority having jurisdiction and/or the Gambling Board. The Customer further consents to and that as part of the registration process, and at any time during the period for which the Customer may be the holder of a betting account with JackpotStar, JackpotStar may supply the identifying details and any related particulars provided by the Customer to third- party service providers, including, without limitation, identity verification and/or screening agencies, cellular network providers, financial institutions, credit bureaus and national and/or provincial governmental agencies or statutory bodies.

3.7. As part of the fulfilment of JackpotStar’s obligations under FICA, the Customer may be required, at the time of the registration process, or at any stage during the period for which the Customer holds a betting account with JackpotStar, to furnish JackpotStar with a copy of his identity documents (i.e. a copy of an identity document and/or passport which must be legible and valid), proof of physical address in the nature of a statement or invoice of account (rendered by a City Council or Municipality or a bank in the case of mortgaged property) and proof of bank account details (which statements shall not be older than three (3) months). JackpotStar shall advise the Customer which documents it may require for this purpose. Failure by the Customer to provide any such document within the timeframe specified by JackpotStar for this purpose:
(i) if required as part of the registration process, will result in the suspension of the registration process, with no betting account being created for the Customer until such time as the information is provided to the satisfaction of JackpotStar; or
(ii) if required at any stage during the period for which the Customer is the holder of a betting account, will result in the suspension and/ or deactivation of the betting account until such time as the information is provided to the satisfaction of JackpotStar or the permanent termination of the betting account, if that Customer fails, neglects or refuses to provide the relevant information.

3.8. As part of the registration process, the Customer will be required to select a dedicated username and secure password in respect of the betting account.

3.9. Once all required verification procedures have been successfully completed, a betting account will be created for the Customer and JackpotStar will transmit a message to the Customer by e-mail confirming the establishment of a betting account in the name of the Customer.

3.10. JackpotStar is obliged to report single cash transactions above R24,999.99 to the Financial Intelligence Centre (“FIC”).

3.11. JackpotStar is further obliged to make reports to the FIC in the event of:
(i) suspicious or unusual transactions; and
(ii) transactions entered into by persons suspected of intending to commit or of having committed any offence contemplated in the Protection of Constitutional Democracy against Terrorist and Related Activities Act, 2004.

3.12. JackpotStar has the right to suspend any Account that has not fulfilled FICA requirements.

3.13. JackpotStar may at any time request a Customer to produce a hard or soft copy his Identity Document or smart card, passport and/or proof of residential address.

4. EVENTS AND CONTINGENCIES ON WHICH BETTING IS OFFERED

4.1. JackpotStar shall, in its sole discretion, determine the markets, events or contingencies on which betting shall be offered by it; provided that:

(i) multiple bets are not accepted where the outcome of one part of the bet contributes towards the outcome of another. If the Customer inadvertently or deliberately backs a related contingency in a multiple bet, the bet will be voided and the stake returned;

(ii) any multiple stake made up of more than one selection from the same event will be deemed to be a related contingency, e.g. Stormers to win the semi-final onto Stormers to win the Tournament; and

(iii) any multiples involving the same team or its players or the same selection will be deemed to be a related contingency e.g. Siya Kolisi to be Man of the Match and South Africa to win the match.

4.2. JackpotStar may from time- to- time determine a minimum or maximum amount that may be staked as a bet in respect of any market or contingency, whether in general or in any given case. It shall be the responsibility of the Customer to enquire before placing a bet on a market or contingency as to whether such maximum or minimum is applicable to that market or contingency and, if so, the extent thereof.

4.3. JackpotStar may determine minimum or maximum amounts that a Customer may win or lose in respect of a bet (“stop wins” and “stop losses”), whether in general or in any given case. It shall be the responsibility of the Customer to enquire before placing a bet on a market or contingency whether such maximum or minimum is applicable to that market or contingency and, if so, the extent thereof.

4.4. JackpotStar may, in its sole discretion, from time- to- time offer the opportunity to Customers to place bets during the course of a certain event (“bets in-running”), provided that JackpotStar may not accept bets in- running in respect of an event that forms part of a series of events over a period of time.

4.5. The nature and extent of any spreads offered by JackpotStar shall be determined from time- to- time at the sole discretion of JackpotStar and it shall be the responsibility of the Customer to enquire, before placing a bet, what the ruling spread is.

5. PROCEDURE FOR PLACING BETS

5.1. The Customer shall place any bets via the internet or mobile betting platform or through such other electronic media as the Services may be made available by JackpotStar.

5.2. Irrespective of the origin or physical location of any electronic signal pursuant to which bets are struck, any betting transaction between JackpotStar and the Customer shall be valid only once such bet has been accepted electronically by a software programme operated at licensed or controlled from premises operated by JackpotStar. Any such bet will be deemed to have been placed at such licensed premises.

5.3. JackpotStar may in its sole discretion elect whether to accept or to reject a bet requested or any component of such bet.

5.4. The Customer authorizes and consents to each electronic communication relating to any bet placed being recorded by JackpotStar in such manner as JackpotStar deems fit and for JackpotStar to retain such recording for so long as JackpotStar deems necessary. The Customer acknowledges that JackpotStar is required to keep such records by law and that such records may be used by JackpotStar for the investigation and resolution of disputes which may arise between itself and the Customer or for any other lawful purpose.

5.5. The Customer shall bear the responsibility of ensuring that any bet placed by the Customer is accurately placed and recorded by JackpotStar. JackpotStar shall furnish such confirmation of a bet to the Customer as may be required by law or as is reasonably requested by the Customer.

5.6. JackpotStar shall accept bets during normal South African business hours and at such other times as JackpotStar may deem fit.

5.7. The Customer shall be responsible for ensuring that he has full knowledge of the rules applicable to the market within which the Customer proposes to place a bet.

5.8. The placement of a bet signifies the Customer’s acceptance of the rules published by JackpotStar in respect thereof and of these Terms.

5.9. While JackpotStar will endeavour to ensure complete accuracy in relation to the announcement, publication and issue of prices, off-times (starting times of events or contingencies) and results, it does not accept responsibility for any errors which may arise in this regard and reserves the right to correct any such errors in such manner as it may determine in its sole discretion. The Customer indemnifies against and holds JackpotStar harmless for and in respect of any losses, whether potential or actual, direct or indirect, which may be suffered by the Customer in consequence of or arising from any such error.

5.10. Any bet alleged by a Customer to have been placed in respect of which the details are not recorded by JackpotStar’s wagering software will not be honoured by JackpotStar.

5.11. The time of acceptance of a bet shall be the South African standard time at which such bet was recorded on JackpotStar’s wagering software.

5.12. Any bet accepted after the “off” or starting time of the event or contingency on which such bet is struck (other than bets in-running) shall be void and of no force or effect. Any bets taken on results already known at the time of the placement of such bets will be voided by JackpotStar.

5.13. Additional or new markets or contingencies may be made available by JackpotStar from time- to- time. It is the responsibility of the Customer to read and to accept the “Market Rules” applicable to such market or contingencies before placing any bets.

6. PAYMENT BY THE CUSTOMER

6.1. A Customer may bet:

(i) against a cash deposit placed with JackpotStar by the Customer from time- to- time by way of an electronic funds transfer evidenced by a bank generated facsimile transmission or e-mail confirming the amount paid and reflecting the Customer’s Account number;
(ii) against a cash deposit physically effected by the Customer directly into the banking account of JackpotStar, which in all cases must be evidenced by proof of transfer with the Customer’s reference to JackpotStar per e-mail to [email protected];
(iii) against an amount of cash to be drawn by JackpotStar as a deposit from the Customer’s credit card account; or
(iv) by making use of such other recognised payment platforms as may be offered by JackpotStar from time- to- time.

6.2. The Customer acknowledges that the deposit referred to in Clause 6.1 will be held and applied as security for the discharge by the Customer of any amount which may become owing by the Customer to JackpotStar.

6.3. The Customer shall under no circumstances place a bet or attempt to place any bet the amount of which, calculated together with any other bets then outstanding, exceeds the Customer’s credit balance with JackpotStar, or the net amount on deposit with JackpotStar (after all adjustments in respect of taxes, winnings and losses up to the time of placing of the bet). It shall be the Customer’s responsibility before placing a bet to determine whether his credit balance or cash deposit, as the case may be, will be exceeded by placing a bet.

6.4. If, owing to a system malfunction or for any other reason, JackpotStar accepts a bet referred to in Clause 6.3, it shall be entitled, at its election, either prior to, during or after the outcome of the event or contingency upon which the bet was placed, to honour the bet or to refund the Customer’s stake in respect of the bet without regard to any winnings thereon. Alternatively, JackpotStar may restrict the size of any stake without notification to the Customer, to ensure that the credit limit or deposit, as the case may be, is not exceeded.

6.5. Acceptance by JackpotStar of a bet over the credit or deposit limit, as the case may be, shall not constitute a derogation from or waiver of its rights:

(i) to collect from the Customer all amounts (including losses) arising from such bet; or
(ii) to enforce the appropriate deposit limits at any later time.

6.6. JackpotStar shall debit the Customer’s betting account in respect of bets accepted by JackpotStar from the Customer on an ongoing basis.

6.7. Credit card deposits may only be made by the cardholder whose name is displayed on the credit card, which must match the name in which the JackpotStar betting account is held.

6.8. The Customer shall be entitled to replenish any cash deposit referred to in Clause 6.1(i) at any time.

7. PAYMENT TO THE CUSTOMER

7.1. JackpotStar shall credit the Customer’s Account in respect of winnings and refunds accruing to the Customer in consequence of bets placed on an ongoing basis.

7.2. No interest shall accrue on any deposits held by JackpotStar.

7.3. If funds are incorrectly credited to a Customer’s Account, the Customer is obliged to notify JackpotStar of the aforesaid error without delay. Unless otherwise notified by JackpotStar, any betting transactions concluded by the Customer subsequent to the error shall be void.

8. RECOVERY OF AMOUNTS DUE TO JACKPOTSTAR

8.1. In the event of a debit balance in the Customer’s Account owing to the acceptance of a bet in excess of the credit or deposit limit, the Customer shall, within three (3) business days of a written demand by JackpotStar for payment of same, pay to JackpotStar such amount either:

(i) by depositing the relevant amount directly into the banking account of JackpotStar, in which event:

a. the Customer’s Account number with JackpotStar must be entered onto the base of the deposit slip; and
b. a copy of the deposit slip must be forwarded to JackpotStar by the Customer; or

(ii) by furnishing JackpotStar with written authorisation, in such format as JackpotStar shall require, for the recovery by JackpotStar of the relevant amount from the Customer’s credit card issuer.

8.2. JackpotStar shall not:

(i) under any circumstances whatever be liable to the Customer if the Customer’s credit card issuer refuses to honour any claim lodged by JackpotStar against the Customer’s credit card. No dispute of whatever nature between a Customer and the credit card issuer shall relieve the Customer from liability to JackpotStar in respect of payment and the Customer shall not be entitled to instruct JackpotStar to reverse a payment instruction that has already been made to the Customer’s credit card issuer;

(ii) be responsible for:
a. any failure, malfunction or delay of any electronic funds transfer unit or other credit card processing machine or its supporting or sharing network, resulting from circumstances beyond the control of JackpotStar; or
b. any damages, loss or expense which the Customer may suffer as a result thereof; and

(iii) be liable for any loss or damage suffered by the Customer as a result of the unauthorized access to any data or as a result of incorrect information supplied through an electronic funds transfer unit or other credit card processing machine or its supporting or sharing network.

8.3. JackpotStar shall be entitled to recover amounts from the Customers in any of the following circumstances (but without limitation to the same):
(i) if there is a debit balance in the Customer’s Account owing to the erroneous acceptance of a bet in excess of limit reflected in the Customer’s Account;
(ii) if JackpotStar has in error credited a Customer’s Account through incorrect bet settlement and the Customer has spent all or part of the incorrectly credited amount;
(iii) if JackpotStar has incorrectly allocated funds to a Customer’s Account and the Customer has spent all or part of the incorrectly allocated amount; or
(iv) if the Customer has placed a bet in breach of these Terms, and such bet is subsequently adjusted so that the Customer has spent all or part of the adjusted balance, resulting in a negative Account balance.

8.4. JackpotStar may in its sole discretion from time- to- time determine the manner in which payments by the Customer to JackpotStar shall be appropriated in respect of amounts owing by the Customer to JackpotStar.

8.5. Should any bets be placed with monies mistakenly credited to a Customer’s Account, JackpotStar has the right to void such bets and shall not be liable for any losses sustained by the Customer in consequence thereof.

8.6. Notwithstanding anything to the contrary herein contained, JackpotStar shall be entitled to set-off any amount(s) due to JackpotStar by the Customer against any funds standing to the credit of the Customer’s betting account or to realise any security held by JackpotStar and to use the proceeds towards payment of any amount due and payable by the Customer to JackpotStar.

9. WITHDRAWAL

9.1. On an ongoing basis, JackpotStar shall credit the Customer’s betting account with all winnings and refunds accruing to the Customer in respect of bets placed.

9.2. The Customer shall be entitled to request the withdrawal of funds standing to the credit of his JackpotStar betting account; provided that the minimum amount which can be withdrawn at any time shall be 50.00 ZAR (Fifty Rand) or such higher amount as JackpotStar may determine from time- to- time, and the transfer thereof into a cheque, savings or credit card account nominated by the Customer for this purpose, by completing a Request for Electronic Transfer of Funds Form, available on the JackpotStar Website and submitting the same to JackpotStar in such manner and format as JackpotStar may determine and shall publish on its Website from time- to- time.

9.3. The Customer shall be solely responsible for ensuring the accuracy of the information supplied in any Request for Electronic Transfer of Funds Form and, by his signature of such Form, shall warrant the accuracy thereof. JackpotStar shall have no liability for the payment of any amount requested into any banking account based in whole or in part on incorrect information provided by the Customer.

9.4. On receipt of a fully completed Request for Electronic Transfer of Funds Form, JackpotStar shall:

(i) perform such investigation as may be required to confirm that the amount requested by the Customer, after making all deductions or adjustments which may be required, is available to be transferred from the Customer’s betting account to the banking account nominated by the Customer for this purpose;
(ii) if the requested amount is not available in the Customer’s betting account, inform the Customer in such manner as JackpotStar may deem fit, that the request has been declined;
(iii) if the requested amount is available in the Customer’s betting account, effect, within 2 (two) business days of confirming the availability of the amount, the electronic transfer of the requested amount from the betting account of the Customer to the banking account nominated by the Customer; provided that, for the purposes of this clause, JackpotStar shall be deemed to have fully complied with its obligation to effect such transfer at the time of giving the instruction to its bankers to effect such transfer and the 48-hour period contemplated in this clause shall not include such further period as may elapse before the requested amount is deposited into the banking account nominated by the Customer for this purpose; and
(iv) immediately reduce the balance standing to the credit of the Customer’s JackpotStar betting account by the amount so transferred.
(iv) 9.5. Amounts withdrawn from any betting account shall only be paid into a South African- based banking account held in the name of the Customer.

9.6. Any withdrawal requested by a Customer may be withheld by JackpotStar pending payment by the Customer to JackpotStar of all monies owing to it by the Customer.

9.7. Prior to releasing any funds from a betting account, JackpotStar may require the Customer to upload proof of his banking account details, issued by the relevant bank. Where required, JackpotStar may perform an online proof- of- banking verification, in order to confirm that the banking account to which withdrawals from the betting account will be transferred is a banking account held in the name of the Customer.

9.8. Before any withdrawals are processed, JackpotStar may request the Customer to upload a valid form of identification, e.g. a copy of a valid ID document and/or passport, driver’s licence or any other valid documentary form of identification. As a result of these checks, there may be a short delay in the processing of the withdrawal. JackpotStar has the right, in its sole discretion, to determine which forms of identification shall be accepted by it. If a Customer has deposited funds via credit cards or Instant EFT or has requested a withdrawal to be paid into a credit card or cheque account, JackpotStar may request copies of both the front side and the back side of the relevant card.

9.9. Subject to Clauses 9.7 and 9.8, JackpotStar will process withdrawal requests within 2 (two) business days following the date of the withdrawal request, i.e. all requests made before midnight on a Monday will be processed before midnight on Wednesday of the same week, and any withdrawal requests made between Friday and midnight on the Sunday of the same week will be processed before the next following Tuesday.

9.10. Any amount transferred into a Customer’s banking account by JackpotStar pursuant to this clause may be subject to a clearance period before becoming available to the Customer.

9.11. Any free bets, bonuses or winnings credited to a Customer’s betting account in error may not be used by the Customer, and, in such cases, JackpotStar may void any transactions performed by the Customer using such funds and/or withdraw the relevant amount from the Customer’s betting account, whether at the time that the transactions take place, or subsequently when JackpotStar becomes aware of such error.

10. ADJUSTMENTS

10.1. JackpotStar may at any time adjust or cancel a Customer’s credit limit.

10.2. Notwithstanding anything to the contrary herein contained, JackpotStar shall be entitled to set-off any amount(s) due by a Customer against any funds standing to the credit of any of the Customer’s Accounts with JackpotStar or to realise any security held by JackpotStar and to use the proceeds towards payment of any amount due by the Customer to JackpotStar.

11. PROOF OF INDEBTEDNESS

11.1. For all purposes of these Terms, a certificate signed by any director, manager, assistant manager, trader or accountant of JackpotStar (whose appointment need not be proved) stating the amount of the Customer’s indebtedness to JackpotStar, shall be prima facie proof of such indebtedness.

12. MONITORING OF BETTING ACCOUNT ACTIVITY

12.1. JackpotStar is both entitled and legally obliged to monitor all activity on Customer’s betting accounts to determine whether any irregular or unlawful activity and/or suspicious or unusual betting account management has occurred. The detection by JackpotStar of any such activity may result in the immediate termination of a Customer’s betting account.

12.2. JackpotStar may withhold the payment of winnings and/or declare bets on an event or a contingency void and/or immediately terminate a Customer’s betting account if there is evidence:
(i) of the misuse or abuse by the Customer of bugs, glitches or errors in or of the JackpotStar betting Services;
(ii) of the use by the Customer of bots or any other form of artificial intelligence;
(iii) that the Customer has hacked, attacked or abused the Services or any servers, software or other components of the Services;
(iv) that the Customer has used VPNs or other software to circumvent any geographic limitations applicable to the Services;
(v) that the Customer has participated in, aided or facilitated criminal, fraudulent and/or illegal activity of any kind;
(vi) that the integrity of the event or contingency on which betting has been struck is called into question;
(vii) that the odds or prices in respect of an event or contingency on which betting has been struck have been improperly manipulated;
(viii) that match rigging, collusion, match fixing, cheating or other unethical activity has taken place; and/or
(ix) that the Customer is prohibited from engaging in betting by any term of his employment contract, any law or any rule of a sporting governing body applicable to the Customer.

13. TERMINATION

13.1. JackpotStar has the right, prior to or after accepting any bet, to temporarily suspend or permanently terminate the rendering of betting Services to a Customer without providing any reason. Upon such suspension or termination:
(i) any amounts owing by the Customer to JackpotStar shall become payable immediately;
(ii) JackpotStar shall, upon the demand of the Customer, refund to the Customer the balance of any monies held by JackpotStar on deposit for the Customer, after adjusting for losses, winnings and taxes and once such funds have been cleared into JackpotStar’s banking account.

13.2. The Customer shall, upon written notice to JackpotStar, be entitled to terminate its contractual relationship with JackpotStar at any time after final conclusion of any betting transaction placed by the Customer and after payment by the Customer of all amounts owing by the Customer to JackpotStar. JackpotStar shall, within a reasonable time after such termination, refund to the Customer the balance of any monies held by JackpotStar on deposit for the Customer, after adjusting for losses, winnings and taxes.

13.3. JackpotStar shall accept no further bets from a Customer in respect whom the provision of Services pursuant to these Terms has been terminated, unless and until a fresh Account application form has been submitted by the Customer and accepted by JackpotStar.

14. BREACH

14.1. If a Customer breaches any of these Terms and fails to remedy such breach within 48 (Forty Eight) hours after receipt of written notice by JackpotStar requiring the breaching Customer to do so, JackpotStar shall be entitled, without prejudice to any other rights it may have in law, forthwith to terminate its contractual relationship with the Customer and to terminate or suspend any bet placed by any such Customer, whether accepted or not, and/or to claim damages from the Customer. In such event:
(i) all amounts owing by the Customer to JackpotStar shall become due and payable immediately; and
(ii) JackpotStar shall have a lien and right of retention over all monies of the Customer on deposit with JackpotStar and/ or in the Customer’s Account, pending settlement of such damages as may have been suffered by JackpotStar.

14.2. Notwithstanding the generality of the aforegoing, the Customer shall be deemed to be in default if:
(i) the Customer commits any act of insolvency;
(ii) the estate of the Customer is sequestrated;
(iii) the Customer endeavours to compromise generally with his creditors; or
(iv) the Customer’s name is entered into the register of excluded persons contemplated in section 14 of the National Gambling Act, 2004.

14.3. The Customer shall be liable for any legal expenses (including legal expenses on an attorney and own client scale, collection commission and/ or charges and tracing fees) and any amount leviable in governmental tax including, but not limited to, value-added tax, which JackpotStar may incur in recovering any amounts owing in respect of the Customer’s Account or as a result of the Customer’s breach of any of the Terms or the enforcement by JackpotStar of any of its rights against the Customer.

15. RESTRICTIONS ON BETTING

15.1. No directors, employees, partners or affiliates of JackpotStar are permitted to place any bets or hold a betting account with JackpotStar.

15.2. No person who in any manner participates in an event or contingency on which betting is offered by JackpotStar may place a bet on any such event or contingency with JackpotStar.

15.3. Any bets placed and/or erroneously accepted in breach of Clauses 15.1 or 15.2 shall be declared void and cancelled.

15.4. Syndicate Betting is strictly prohibited by JackpotStar. “Syndicate Betting” means a group of persons acts together for the purposes of placing a bet or series of bets on the same event, contingency or market. JackpotStar has the right to void all bets in relation to any Syndicate Betting and to withhold payment of winnings temporarily or permanently, pending the outcome of or after an investigation by JackpotStar.

16. VOID BETS

16.1. JackpotStar has the right to declare any bet wholly or partially void, if any such bet:
(i) has been offered, placed or accepted as the result of an error;
(ii) has been accepted in circumstances in which such bet would not ordinarily have been accepted, e.g. owing to technical problems occurring in relation to the operation of JackpotStar’s website;
(iii) has been placed in consequence or in the process of Syndicate Betting;
(iv) has been struck in relation to an event or contingency of which the result was unlawfully determined or influenced by unlawful conduct;
(v) has been struck in relation to an event or contingency in respect of which a subsequent announcement has been made which significantly alters the prevailing odds in respect of such bet; or
(vii) any other state of affairs beyond the control of JackpotStar has arisen subsequent to the placement and acceptance of such bet, which materially affects the conduct of the event or contingency on which it was struck or the prevailing odds available in respect thereof, including acts of God, a national, provincial or global state of emergency, an epidemic or pandemic, or the like.

16.2. JackpotStar may void a bet at any stage, for any lawful reason

16.3. Unless required otherwise by applicable law, if a bet is voided, the amount staked by a Customer shall be returned to him.

16.4. In the case of a scratched selection in a single bet, the bet shall be void, except where the bet was an ante-post bet.

16.5. In the case of an invalid selection and subsequent scratching in a multiple or combination bet, the selection shall be ignored, and the stake shall run onto the other selection in the bet at the price indicated on the ticket issued. These calculations are to be done at “Full Accumulative Multiple” odds.

16.6.1 A Customer is not entitled to any winnings or to receive a payout from JackpotStar and JackpotStar may in its absolute discretion determine the validity of a bet or a Customer’s entitlement to winnings or a payout or void a bet in, inter alia, the following circumstances:
(i) the integrity of an event or contingency or any series thereof has been called into question or is suspected to be compromised;
(ii) the price(s) or pool have been manipulated;
(iii) match- rigging or fixing has taken place or the event or contingency is under investigation by any party as a result of an allegation to that effect;
(iv) the bet was placed by or on behalf of a Customer or other person who has been involved in any fraud- related activities in relation to the placing of the bet, the operation of the Customer’s betting account or otherwise;
(v) in relation to any betting event or contingency, fraud, technical and/ or human error or unwarranted influence or manipulation was found or is being investigated by any party; and/ or
(vi) any of the aforegoing or related circumstances is being investigated by us or a third party (including any insurer, underwriter, regulator or governmental agency or authority).
The aforegoing shall not in any manner derogate from JackpotStar’s other rights conferred elsewhere in Clause 16 or otherwise in these Terms.

16.6.2 All Type A Prize Category payouts are subject to enhanced customer verification and due diligence procedures and the satisfaction of third party audits by the relevant Underwriter or their nominated agents.

17. BETTING AND PAYOUT LIMITS & INSURANCE:

17.1. JackpotStar has the right to limit the net pay- out on any bet or combination of bets by any Customer. This limit may be lower or higher, depending on the specific sport, league, contingency and/ or type of bet offered.

17.2. The maximum total pay- out limit per Customer per day is 5,000,000.00 ZAR (Five Million Rand). For the avoidance of doubt, this means that no Customer may be paid out more than a total of 5,000,000.00 ZAR (Five Million Rand) in respect of any number or combination of winning betting tickets resulted on a single day, other than Underwritten Winning Entries, as defined below in this Clause 17, to which the limitation in this clause does not apply.

17.3. Different maximum pay- out limits may be set in respect of individual games or contingencies offered by JackpotStar on a per hand, per draw or a per round basis. These limits are stipulated in the rules applicable to each game or contingency, which rules can be accessed by clicking on the link to the rules displayed on the Website in respect of each game or contingency. JackpotStar has the right (but not the obligation) in its sole and unfettered discretion to pay- out an amount greater than the stipulated maximum pay- out amount to any winning Customer on a case-by-case basis.

17.4. Underwritten Winning Entries means that JackpotStar utilises the services of a(n) underwriter(s) and/ or syndicated underwriting arrangement (“Underwriter”) in respect of certain of the lottery betting- related products offered by it, and may also enter into other commercial arrangements for the underwriting which enables it to guarantee the payment of winnings. JackpotStar shall be under no obligation to pay a Customer if an Underwriter fails to pay out any claim in respect of a winning Customer’s bet to JackpotStar.

17.5. In respect of winnings on lottery draws, the chart below provides an overview of the Classes offered in each Prize Category (“Table”):

17.5.1. WINNINGS IN PRIZE CATEGORY A:

Maximum Payouts
All bets placed via the Website by a Customer that is a resident of South Africa in which there is any winner of the Underlying Lottery in a Type A Prize Category, will be capped at 500,000,000.00 ZAR (Five Hundred Million Rand) per Customer, irrespective of the number of winning bets placed by such Customer on the outcome of the relevant Underlying Lottery.

In the event of more than one winning bet in a Type A Prize Category placed via the Website by Customers that are residents of South Africa, then all winning bets placed by Customers that are residents of South Africa will be capped at 500,000,000.00 ZAR (Five Hundred Million Rand) per Customer, irrespective of the number of winning bets placed by any such Customers on the outcome of the relevant Underlying Lottery.

The winnings to be paid out in respect of each JackpotStar winning bet in a Type A Prize Category (as defined in the Table, for example Prize Category 1 in EuroMillions) will depend on the number of the Underlying Lottery Winning Tickets in that Prize Category, the number of JackpotStar winning bets in that Prize Category, the number of JackpotStar winning bets in that Prize Category relating to Customers that are residents of South Africa betting via the Website, the payable Prize by the Underlying Lottery Operator for the Underlying Lottery Winning Tickets in that Prize Category as well as the Underlying Lottery Jackpot in that Prize Category.

JackpotStar calculates the winnings in a Type A Prize Category on the basis of the amount of aggregate stakes published by the Underlying Lottery Operator as well as the distribution to that Jackpot Prize Category or on the basis of the jackpot published on the website of the Underlying Lottery Operator for that Prize Category of the relevant draw of the Underlying Lottery.

Only one JackpotStar winning bet in a Type A Prize Category in respect of a Customer that is a resident of South Africa betting via the Website:
If there is only one JackpotStar winning bet in a Type A Prize Category that relates to a Customer that is a resident of South Africa betting via the Website, the winnings payable in respect of this JackpotStar winning bet are calculated as:

Example 1: There is only one JackpotStar winning bet in the Type A Prize Category that relates to a Customer that is a resident of South Africa betting via the Website and no Underlying Lottery Winning Ticket nor any other JackpotStar winning bet has been announced by either the Underlying Lottery Operator or JackpotStar in the Type A Prize Category in respect of an Underlying Lottery Jackpot in the Type A Prize Category of 900,000,000.00 ZAR (Nine Hundred Million Rand). The winnings payable in respect of that single JackpotStar winning bet relating to a Customer that is a resident of South Africa amount to 900,000,000.00 ZAR (Nine Hundred Million Rand).

Example 2: There is one JackpotStar winning bet in the Type A Prize Category that relates to a Customer that is a resident of South Africa betting via the Website and also one or more Underlying Lottery Winning Tickets and/or one or more JackpotStar winning bets have been announced by either the Underlying Lottery Operator or JackpotStar in the Type A Prize Category in respect of an Underlying Lottery Jackpot in the Type A Prize Category of 900,000,000.00 ZAR (Nine Hundred Million Rand). The winnings payable in respect of the JackpotStar winning bet relating to a Customer that is a resident of South Africa amount to 500,000,000.00 ZAR (Five Hundred Million Rand).

More than one JackpotStar winning bet in the Type A Prize Category in respect of numerous Customers that are residents of South Africa betting via the Website:

If there is more than one JackpotStar winning bet in the Type A Prize Category relating to Customers that are residents of South Africa betting via the Website, then the winnings payable in respect of the JackpotStar winning bets relating to each Customer that is a resident of South Africa amount to 500,000,000.00 ZAR (Five Hundred Million Rand).

Winnings other than Keno are paid out in Euros. The rate used to convert winnings to Rands will be the actual rate of exchange applied by JackpotStar’s bank when the funds are received from the Underwriter and converted from Euros to Rands.
JackpotStar can at its discretion, at the time of paying out winnings, increase the maximum pay-out value per event up to the full advertised jackpot amount.

17.5.2. WINNINGS IN PRIZE CATEGORY B:

Winnings to be paid out in respect of each JackpotStar winning bet in a Type B Prize Category (as set out in the Table- for example, Prize Category 2 in EuroMillions) shall be calculated in the same manner as winnings in a Type A Prize Category.

17.5.3. WINNINGS IN PRIZE CATEGORY C:

The winnings to be paid out in respect of each JackpotStar winning bet in a Type C Prize Category (as set out in the Table- for example Prize Category 4 in EuroMillions) shall be the amount of the prize announced by the Underlying Lottery Operator in respect of an Underlying Lottery Winning Ticket in the respective Prize Category. If the Underlying Lottery Operator has not announced a prize in the respective Prize Category for the relevant draw of the Underlying Lottery, the winnings payable in respect of each JackpotStar winning bet in that Prize Category will be calculated on the basis of the aggregate amounts paid in for the relevant draw of the Underlying Lottery announced by the Underlying Lottery Operator and its allocation to the winning Prize Categories.

17.6. PAYOUT OF PRIZES IN MEGA MILLIONS & POWERBALL

Payout of Prizes in Mega Millions and PowerBall

As is common practice with the pay outs of wins on The Multi-State Lottery Association (“MUSL”) Mega Millions and Powerball jackpots, JackpotStar may also opt to pay out the winnings in Prize Category 1 over 30 years (the “Annuity Option”). If JackpotStar chooses the Annuity Option, the first payment will be made as soon as practicably possible after the draw, with the next 29 payments at one- year intervals. The level of payments is calculated such that the payments rise by the percentage set by MUSL from year to year until the full sum has been paid out. If JackpotStar chooses the option to pay out winnings in one lump sum (“Cash Option”), the winnings after withholdings are discounted, as it is done in MUSL Mega Millions and Powerball. The discount rate is 40%, i.e. the lump sum is 60% of the Annuity Option value. It is in JackpotStar’s discretion to choose the pay- out plan.

17.7 PAYOUT OF PRIZES IN MEGA MILLIONS MINI, POWERBALL MINI, SUPERENA MINI, CASH4LIFE, MINI LOTTO, EUROMILLIONS MINI and EUROJACKPOT MINI

Payout of Prizes in Mega Millions Mini, Powerball Mini, SuperEna Mini, Cash4Life, Mini Lotto, EuroMillions Mini and EuroJackpot Mini are paid out as published on the Website and independent of the Winnings published by the Underlying Lottery Operator.

17.8 WITHHOLDINGS

Withholdings for Prizes in Mega Millions / Mega Millions Mini and PowerBall / Powerball Mini

Prizes in the highest three prize categories in Mega Millions / Mega Millions Mini and PowerBall / Powerball Mini will be paid net of 38% withholdings as is commensurate with the terms of the respective Underlying Lottery.

Withholdings for Prizes in SuperEnalotto, SuperEna Mini, La Primitiva, El Gordo and Mini Lotto

Prizes in the highest three prize categories on SuperEnalotto / SuperEna Mini and the three highest prize categories on both El Gordo and La Primitiva will be paid net of 20% withholdings as is commensurate with the terms of the respective Underlying Lottery. The highest prize category on Mini Lotto will be paid net of 10% withholdings as is commensurate with the terms of the respective Underlying Lottery.

17.9. SPECIAL JACKPOTS:

For all games, JackpotStar has the option to announce (a) Special Jackpot(s) at its sole discretion and in conjunction with an Underwriter or Underwriter’s Group. For these Special Jackpot(s), JackpotStar may at its sole discretion increase the bet price. If a Special Jackpot is announced, then the Special Jackpot sum announced will replace any Underlying Lottery Jackpot in that Type A Prize Category. Special Jackpot entries will be underwritten by an Underwriter or Underwriter’s Group and the pay- outs of prizes for these Special Jackpots will follow the same rules as the Underlying Lottery that the particular game is based upon. Prize Category A winners of Special Jackpots will split the amount amongst the total number of winning entries placed with an Underwriter or Underwriter’s Group for that particular game.

18. ERRORS

18.1. JackpotStar has the right, in its sole discretion, to adjust, limit, cancel and/or reject any bet determined by it to have been accepted by it in error.

18.2. If an official correction is made in respect of any price on any event or contingency that had previously been incorrectly advertised or transmitted, all bets struck at that erroneous price shall be settled at the corrected price.

18.3. If any odds in respect of a bet, event or contingency have been misstated:
(i) as a result of a system or computer malfunction; or
(ii) in consequence of any other error, in circumstances where it is reasonably clear that the odds stated are incorrect when compared with the odds prevailing in the greater market,
the bet, event or contingency will be deemed to have occurred and will be settled on the correct price(s) which were available in the general market at the time the bet was struck.

19. LIMITATION OF LIABILITY

19.1. The liability of JackpotStar to a Customer for any losses or damages sustained by the Customer from any cause whatsoever including any losses or damages arising out of the negligence of JackpotStar or that of its servants, agents or sub-contractors, shall in all events and under all circumstances be limited:
(i) in the event of losses or damages relating to a bet, to the amount staked by the Customer in respect of such bet; or
(ii) in respect of the Account of the Customer with JackpotStar, to the credit balance of such Account at the time during which the losses or damages are alleged to have occurred, after full adjustment for winnings, losses and taxes.

19.2. To the fullest extent permitted by law and notwithstanding any other provisions in these Terms, JackpotStar shall under no circumstances whatsoever be liable for any loss of profits, winnings or potential profits or winnings or any indirect or consequential damages sustained by a Customer, whether or not caused by the negligence of JackpotStar, its agents or employees or otherwise.

19.3. Insofar as any of the obligations of JackpotStar under these Terms are carried out by any JackpotStar’s officers, servants, employees, agents, sub-contractors, associates or subsidiaries, the provisions of Clauses 19.1 and 19.2 shall apply mutatis mutandis and each of them shall be exempted and held harmless accordingly.

19.4. JackpotStar shall not be liable if a Customer is unable to place a bet due to the malfunctioning of any electronic media used for the purposes of betting.

19.5. Any acts of God, war, strike, lock-out or other labour dispute, fire, flood, explosion, the enactment, amendment or repeal of legislation, failure of electricity or any other supplies, failure of telecommunications, failure, theft or default of any computer hardware or software or any other equipment, epidemic or pandemic or any other similar or different cause beyond the reasonable control of JackpotStar leading to the cessation and/or restriction of the operations of JackpotStar, shall entitle JackpotStar to postpone its obligations to the Customer in whole or in part, and in such event JackpotStar shall not be responsible for any loss or damages of any nature suffered by the Customer, whether directly or indirectly, as a result thereof and the Customer shall not be entitled to terminate its contractual relationship with JackpotStar as a result of any such occurrence.

19.6. The Customer agrees that he makes use of JackpotStar’s Services at his own and sole risk and that he assumes all responsibility for his use of the Services. Except where expressly provided otherwise, the Website, all content provided on or through the Website and on any other electronic medium through which a Customer uses the Services, and JackpotStar’s Services are provided on an “as is” basis.

19.7. JackpotStar shall not be responsible for:
(i) any failure, malfunction or delay of any electronic funds transfer unit or other credit card processing machine or its supporting or sharing network, resulting from circumstances beyond the control of JackpotStar;
(ii) any damages, loss or expense which a Customer may suffer as a result thereof; and
(iii) any loss or damage suffered by a Customer as a result of the unauthorised access to any data or as a result of incorrect information supplied through an electronic funds transfer unit or other credit card processing machine or its supporting or sharing network.

19.8. The Customer specifically indemnifies and hereby undertakes to indemnify JackpotStar, its employees, officers, directors and any and all associated or affiliated persons or organisations against any and all costs, expenses, liabilities and damages arising from any legal or other action either taken arising from any and all interactions with JackpotStar and/or its employees, officers, directors and any and all associated or affiliated persons or organisations. Such legal or other action shall include (but not be limited to) any legal or similar action that arises or may be taken in relation to the alleged unlawfulness of interactive and/or online gambling or gaming within any jurisdiction in which a Customer is located.

20. DISCLOSURE OF INFORMATION AND PRIVACY

20.1. The Customer hereby consents to checks being made against third-party databases to verify the Customer’s identity, personal details and/or credit card information, and/or any other information supplied by the Customer in respect of which JackpotStar deems it necessary to procure independent verification. The parties with which JackpotStar contracts for the verification of information may keep records of all data requests and data submitted to them by JackpotStar and the Customer hereby consents thereto.

20.2. The Customer acknowledges that JackpotStar may be legally required to, and when required to shall, disclose to any governmental bodies or regulatory agencies, information pertaining to the identity and personal particulars of the Customer, betting account of the Customer and the activity on such Account.

21. DISPUTES

21.1. If a dispute arises between a Customer and JackpotStar in relation to the liability of JackpotStar to pay alleged winnings to the Customer, and that dispute cannot be resolved between the Parties, the dispute may be referred by either JackpotStar or the Customer to the Gambling Board for resolution in terms of applicable legislation.

21.2. The ability to refer a dispute to the Gambling Board for resolution shall in no way supersede or supplant JackpotStar’s or a Customer’s right to have a dispute adjudicated upon by a court of competent jurisdiction.

21.3. The Customer hereby consents to the jurisdiction of a Magistrate’s Court having jurisdiction in terms of Section 45 of the Magistrate’s Court Act of 1994 (or any similar act replacing the act) for the purposes of any legal proceedings in terms of or incidental to this Agreement notwithstanding the quantum of the claim. If JackpotStar are the successful litigant in any such proceedings, the Customer shall pay JackpotStar’s legal costs on a scale as between attorney and own client together with interest on any amount owing to JackpotStar a tempore morae and collection costs and commission.

22. EXCLUSION FROM BETTING ACTIVITY

22.1. A Customer may, at any time, request that he be temporarily or permanently excluded from further participation in betting and therefore use of the Services.

22.2. Any Customer who believes that he may have a gambling problem, is encouraged to complete the National Responsible Gambling Programme’s (“NRGP”) Online Checklist [here: https://responsiblegambling.org.za/self-check-quiz/] to help determine his vulnerability to gambling addiction. 22.3. If a Customer self-excludes, he is obliged to advise JackpotStar in writing of such self-exclusion, whereupon JackpotStar will immediately close the Customer’s betting account.

23. OTHER

23.1. The residential address furnished by the Customer on the Account application form shall serve as his domicilium citandi et executandi for all purposes in respect of these Terms.

23.2. The physical address reflected in respect of JackpotStar on its Website, as amended from time- to- time, shall serve as its domicilium citandi et executandi for all purposes in respect of these Terms.

23.3. The Customer shall have the right to change his domicilium citandi et executandi by giving one week’s prior written notice to JackpotStar of such change of address.

23.4. Any notice given by a Customer in terms of Clause 23.3 shall be deemed to be received on the actual day that it is received by an officer of JackpotStar.

23.5. JackpotStar may at any time amend, replace or delete any of the terms contained in these Terms and shall at all times ensure that current Terms are available on its Website. It shall be the responsibility of the Customer to ensure that he is familiar with the Terms in force from time- to- time and the availability thereof on the Website shall constitute sufficient notice thereof to the Customer and shall bind the Customer as if the Customer had expressly agreed to be bound thereby.

23.6. Any relaxation, concession or extension granted by JackpotStar to the Customer shall not be and shall not be deemed to constitute a novation or waiver of any of JackpotStar’s rights under these Terms.

23.7. JackpotStar is entitled to supply, request or acquire any relevant credit, account- related or other information relating to a Customer and a Customer’s betting account to or from:
(i) a credit bureau;
(ii) any bank or regulatory agency; or
(i) any other person or entity,
if JackpotStar deems it necessary to supply, request or acquire such information for verification or any other purposes, and the Customer shall have no right of recourse against JackpotStar by reason thereof or arising therefrom.

23.8. These Terms constitute the whole agreement between JackpotStar and the Customer and no agreements, representations or warranties, other than those set out herein, shall be of any force or effect.

23.9. Save as provided otherwise in these Terms and without derogating therefrom, no addition to, variation, consensual cancellation or novation of any of the Terms and no express or implied waiver of any of the rights arising therefrom shall be of any force and effect unless reduced to writing and signed by JackpotStar and the Customer or their duly authorised representatives.

23.10. Any promissory note, bill of exchange or other negotiable instrument received by JackpotStar from a Customer shall not constitute a novation of the debt in respect which it is given, and the Customer waives any remedies provided for by law in respect thereof.

23.11. The resulting of any match, event or contingency will be decided with reference to the official match results of the league, tournament, event or contingency in question. If the results change for any reason, the updated result will be utilised and binding for the purposes of payment.

23.12. Any bet placed by a Customer shall be governed by the applicable provisions of the Western Cape Gambling and Racing Act, 1996 and any Regulations and Rules made in terms thereof (as amended from time- to- time) to which links are posted on the JackpotStar Website. It shall be the responsibility of the Customer to ensure that he is aware of these provisions.

23.13. The Customer undertakes to strictly adhere to any policy, guideline or directive issued by the Gambling Board relating to the Customer or to betting in general.

23.14. These Terms and the business relationship between the Customer and JackpotStar shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

23.15 Any reference in these Terms to any one gender includes the other two genders.

23.17. Although every effort is made by JackpotStar to ensure that the information displayed on its Website regarding any event or contingency is accurate and complete, such information should be used as a guide only. If any information relating to an event or contingency (e.g. score, starting time of event etc.) is incorrect, JackpotStar shall have no liability for such error. The official site for the sport in question should be referred to in the event of any dispute in this regard.
